These Terms of Service ("Terms") govern your use of the TolHouse Member mobile application ("App") and website, owned and operated by TolHouse ("Company," "we," "us," or "our"), located in Toledo, Ohio. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
1.1. Eligibility: To use the App, you must be a registered member of TolHouse or have been invited to create an account.
1.2. Account Information: You agree to provide accurate and complete information when registering for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
1.3. Membership Termination: The Company reserves the right to terminate or suspend your membership and access to the App at any time, without prior notice or liability, for any reason, including but not limited to breach of these Terms.
2.1. License: Subject to these Terms, the Company grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use as a TolHouse member.

2.3. Content: The App may allow you to post, share, and make available certain information, text, graphics, or other material ("Content"). You are solely responsible for the Content you post and agree not to post Content that is unlawful, defamatory, or infringes upon the rights of others.
3.1. Event Bookings: Members may book events through the App subject to availability. Booking confirmations are not guaranteed until confirmed by TolHouse.
3.2. Room Reservations: Private rooms and meeting spaces may be reserved through the App. Reservation policies, including cancellation terms, are displayed at the time of booking.
3.3. Check-In: The App uses location services to facilitate check-in at TolHouse. Location data is used solely for this purpose and is handled in accordance with our Privacy Policy.
Membership fees and any charges for services booked through the App are processed by Stripe, our third-party payment provider. By making a payment, you agree to Stripe's terms of service. The Company does not store your credit card information. All payment disputes should be directed to the Company first at hello@tolhouse.com.
Your use of the App is subject to our Privacy Policy, which describes how we collect, use, and disclose your information. By using the App, you consent to the practices described in the Privacy Policy.
The Company retains all rights, title, and interest in and to the App, including all intellectual property rights. You agree not to reproduce, distribute, modify, or create derivative works of the App or any part thereof without the Company's prior written consent.
The App is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. The Company disclaims all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, or loss of data, arising out of or in connection with your use of the App.
These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. Any legal disputes arising from these Terms shall be resolved in the courts of Lucas County, Ohio.
The Company reserves the right to modify or replace these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the App after changes constitutes acceptance of the updated Terms.
